The Lights Are On..But Apparantly, Nobody's Home!

It seems that the full time city attorney proposal is back on the council's agenda and it makes no more sense now than it did when last we spoke of it. To repeat (again), a one person city law department is going to solve none of the city's lack of code enforcement issues.

Further, since the administration did not request an increase for more staff for that department in the 2007 budget, there is likely less money in the till for that purpose than there was previously given the higher costs of everything since last year.

Ah, but this is only one of many reocurring and unresolved issues New Albany citizens face.

Groundhog Day (the movie) comes to mind as does the insanity of doing the same thing, the same way repeatedly and expecting different results.

Many of the council members complain that needed information is withheld from them but seem unwilling to do the legwork to find answers to questions. Perhaps rephrasing the question would help? But NO! "If it ain't in my packet, which I won't bother to open until I get to the meeting in question, I ain't gonna go ask nobody to explain it to me! I'm just gonna plant my feet, cross my arms, and blame whomever happens to come to mind first!"

Many in the administration say that the council can have whatever information it asks for provided they ask the right questions. Perhaps clarifying specifically what the council is seeking and then providing it in a timely manner would help? But NO! " If they want more specific data, they can track down the individual who can give it to them on their own time. If that person happens not to be available for comment at that time, too bad! Furthermore, we ain't volunteering anything!"

Then we come to the public at large. Many complain about barking dogs, trash, utility rates, taxes, slumlords, crime, potholes, and our governments inaction towards all of these issues & more. We say amongst ourselves that "We gotta do something!" Perhaps taking the time to go downtown and talk one on one with our city's leaders or attending the various public meetings and expressing ourselves like adults would help? But NO! "It is their job to provide me with what I want out of them regardless of the fact I've never told them specificaly what that is! I shoudn't have to be aware of what is on the agenda for a particular meeting! Furthermore, I shouldn't have to pick up the phone and tell anybody that there is trash in my alley or that my house is on fire, or that the street just caved in and I reserve the right to complain to all who will listen about their failure to act upon it!"

You will note (I hope) that I said many, not all, in these three secenarios. Are any of them true? Unfortunately yes. All of them are to one degree or another.

So now I pose two questions for your consideration and I request that you post your answers in the comments section. Please be specific.

Question #1; What do you want out of your city government?

Question #2; What are you willing to do to cause it to happen?

I eagerly await your answers and discusssion.

The political clan in NA is so well trenched in, it would be easier to solve the Kennedy murder and all that goes along with it past and present.

At the local level, all I want from elected officials are:
1. Accountability
2. Competence

I am very willing to vote 'em out, and I plan to do my part to do so in the upcoming elections.

Also, regarding the attorney issue, a city of 40,000 needs at least one full-time attorney. I does, however, ALSO need a city court, as well as staff for both the attorney and the court, in order to enforce ordinances.

My reasoning behind multiple part time as opposed to one full time attorney is as follows;

A)The senior or lead, if you will, is responsible for the city's corporate business. That means labor agreements, contracts with outside entities, and other legal formalities. The second or subsequent persons can be assigned to dedicate their time to specfic tasks such as prosecuting code/ordinance violators and collecting monies due the city.

B)Realistically, there is not enough dollars in the piggy bank to hire a full timer and a part timer & staff. However multiple partimers & staff is doable.

As for the city court issue, while I agree that it is needed, we can't by Indiana Statute create one before 2010. We can however start to lay the groundwork for it as I think we should.

As to Sam Adams comment, although I agree that the status quo is well rooted, does this mean we should just lie down and let them have thier way with us? The few dominating the many?

I think not and I certainly hope not!

I think 2 part timers COULD work, if they were very active and if they have sizeable staffs that are competent and very active as well.

As for the court, I was not aware of the statute, but I agree, let's get ready for 2010.

Being a citizen of a democratic republic, and the states/cities therein, costs money. I don't mind paying, but we must begin to demand competence from those we elect or hire.

The two advantages of having a city court are that the city gets to keep the bulk of the monies collected which helps pay for the extra law department personnel.

Other than that, you are correct.

Ceece, a couple of questions your research may have answered already:

1. Does the law allow the city to add ordinance violation fines to property taxes without any sort of legal judgement against the property owner?

2. If the fines are collected via property taxes, does it mean that the state controls the dollars rather than the city?

I'd like to see a huge narcotics squad move into town and clean up all the human garbage oozing outta so many rat-holes, or what do they call them here - rental apartments? I'd like to see two full time attorneys and a competent staff AND a city court to start to re-balance our books post slumlord plantation. Not to mention repealing all the tax abatements and other tax goodies the idiots "minding" the store pass out like penny candy at a sucker parade. I guess I'd like to see everyone in government at present sent out to pasture and get in a new motivated competent crew. VOTE!
